Charges proceed for driver who struck pedestrians

On Sept. 26, District Attorney Gavin P. Holihan announced all charges will proceed to Lehigh County Court of Common Pleas in a homicide and attempted murder case that occurred in August in Whitehall Township. Rajgion Davis, 55, of Whitehall, is charged with criminal homicide, two counts of attempted murder and two counts each of aggravated assault — all felonies of the first degree.
Whitehall Township police were called just after 6 p.m. Aug. 9 for what was initially described as a motor vehicle accident with pedestrians struck in the area of 1339 N. 14th St.
Numerous eyewitnesses described an incident that was later determined to be an intentional act by Davis, who arrived at the scene driving a gray sedan and crashed into an unoccupied vehicle owned by Francesca Washington, Holihan said.
Davis then reportedly fled the scene. Minutes later, while Washington was assessing the damage to her vehicle, she was joined in the parking lot by two neighbors — Stephen and Yesenia Fistner, who were walking their dog.
While they were standing together in the parking lot, Davis allegedly returned to the area in the gray sedan and drove directly at all three individuals. A witness described Stephen Fistner pushing his wife out of the way of Davis’ car immediately before a violent impact between the car, Washington, Stephen Fistner and two other unoccupied vehicles, according to Holihan.
Washington suffered grievous bodily injury and remains hospitalized.
Fistner, 53, of Whitehall, succumbed to his injuries at Lehigh Valley Hospital. His death was ruled a homicide by the Lehigh County coroner.
Davis was able to walk away and leave the scene, but numerous members of the community called 911, assisted the victims and followed Davis while recording him on their cellphones. Davis was taken into custody by Allentown police officers, during which time he reportedly indicated his intention was to harm and kill Washington, Holihan said.
At a preliminary hearing Sept. 25, Magisterial District Judge Jacob E. Hammond ordered that all charges proceed to court. Davis remains in Lehigh County Jail without bail.
Davis will be formally arraigned Oct. 30 before Lehigh County Common Pleas Judge Thomas M. Caffrey. The case will be prosecuted by Chief Deputy District Attorneys Christine F. Murphy and V. Paul Bernardino III.
