Whitehall man dies from ‘intentional collision’

Witnesses at scene help officers locate suspect; criminal charges filed

Whitehall Township community members came together to help police during a motor vehicle collision with pedestrians. The Aug. 9 incident was described as intentional by eye witnesses and law enforcement.

Police reportedly responded to a report of a motor vehicle accident involving a pedestrian at 1339 N. 14th St., Whitehall. The call reportedly came in just after 6 p.m. Aug. 9, according to a release from Lehigh County District Attorney Gavin P. Holihan.

According to eyewitness reports, Rajgion Davis, 55, of Whitehall, allegedly drove his vehicle, a gray sedan, into an unoccupied Toyota RAV-4, which is owned by Francesca Washington, Holihan said. He then reportedly left the scene.

Washington reportedly arrived on the scene to assess the damage to her vehicle. Holihan reported two of Washington’s neighbors — Stephen and Yesenia Fistner — were walking their dog and stopped to talk.

According to Holihan, Davis returned to the scene and allegedly drove directly at all three individuals. A witness told law enforcement Stephen Fistner, of Whitehall, pushed his wife out of the way before impact. The impact affected Davis in his vehicle, Stephen Fistner, Washington and two other unoccupied vehicles, Holihan said. Davis reportedly fled the scene on foot.

According to Holihan, Washington remains hospitalized for “grievous bodily injury.”

Stephen Fistner was pronounced dead around 7 p.m. Aug. 9 at Lehigh Valley Hospital-Cedar Crest, according to Lehigh County Coroner Daniel A. Buglio.

The autopsy was performed Aug. 12. According to Buglio, Fistner’s cause of death is blunt force injuries due to a pedestrian and motor vehicle collision. The manner of death was ruled a homicide, Buglio reported.

According to Holihan, community members nearby called 911, assisted the victims and followed Davis while taking videos on their phones. Police from Whitehall, South Whitehall and Allentown responded and followed witness directions to Davis.

Allentown officers took Davis into custody. Holihan reported Davis “indicated that his intention was to harm and kill Washington.”

Davis is charged with criminal homicide, two counts each of attempted murder and two counts each of aggravated assault, Holihan reported. All charges are felonies of the first degree. Holihan and Whitehall Township Police Chief Michael Marks announced the arrest in a release Aug. 10.

Stephen Fistner, a Southern Lehigh High School graduate, worked at Mack Trucks, Macungie. He is survived by his wife, two children, his mother and a sister.

There will be a viewing 9-10:30 a.m., followed by services 10:30 a.m., Aug. 16 at Bachman, Kulik and Reinsmith Funeral Home, 1629 Hamilton St., Allentown.

The investigation is continuing. According to Holihan, a motive has not yet been disclosed. The only connection currently revealed between Davis and Washington is they were reportedly neighbors in the past.

Davis was arraigned Aug. 10 by Magisterial District Judge Daniel Trexler and committed to Lehigh County Jail without bail, Holihan said. His preliminary hearing is scheduled for 11 a.m. Aug. 16 at Lehigh County Central Court.

This investigation included the work of many agencies, including the police departments of Whitehall Township, South Whitehall Township and Allentown; Lehigh County Homicide Task Force; Lehigh County Coroner’s Office; and the Lehigh County CRASH team, Holihan said.

“We would also like to express our appreciation for numerous members of the community who contacted 911 immediately; who sought to aid the victims; and those who followed the suspect and were able to help police identify Davis and detain him,” Holihan said. “Also, we thank members of the community who provided investigators with video evidence of what happened. It is because of all the hard work by investigators and help from the community that we are able to announce this arrest so quickly.”
