North Whitehall’s Zoning Hearing Board voted unanimously against all three motions for appeal by Cheryl Reinert, owner of Foxy’s Cradle neonatal kitten rescue at 5248 Overlook Road.
Zoners said Reinert violated the township zoning ordinance by failing to apply for permits for altering her home for the kittens.
The board noted operating a neonatal cat rescue shelter is not a permitted use within the agricultural rural zoning district.
Zoners noted operation of the rescue shelter is a principal use in violation of the zoning ordinance.
Foxy’s Cradle representative Kandice Reinert emailed The Press the following statement on Dec. 21, 2023: “Our attorneys have informed us the township has 45 days to issue a written decision.
“Once we receive that written decision, yes, we will appeal, and the appeal will go to the Lehigh County Court of Common Pleas.”
The zoning hearing board also granted a continuance request by McDonald’s Corporation for its appeal to Jan. 17.
