Board rejects state law change

Township commissioners amended the Stormwater Management Ordinance, as required by the state Department of Environmental Protection, Aug. 7.

A motion was made to advertise the change, which Township Engineer Ron Gawlick said generally covers the design and installation of drainage and runoff control facilities in the township.

Commissioners also passed a motion opposing state legislation to amend The Municipal Claim and Tax Lien Law, dating back to May 16, 1923. Solicitor Jim Broughal explained to the board, “If there was a mortgage foreclosure on a piece of property, when that property was sold, it was sold free and clear of the mortgage but the tax liens and the municipal liens survived.”

Bill 291 would change this. According to Broughal, “There’s now a bill pending that would remove municipal liens from the pecking order and make it come after the foreclosure. So, what would happen is the taxes would have to be paid but then the bank would get paid. And if there was any money left, the municipal liens would get paid but if there wasn’t any money left, they wouldn’t get paid.”

The motion also allows commissioners to reach out to local legislators about the bill.
