New single-family house; second-story deck granted variances in Salisbury

Two appeals were granted in July by the Salisbury Township Zoning Hearing Board.
The appeal of Nicholas Cassella, 1455 Garden Ave., was granted for a request for a dimensional variance to construct a second-story deck within the rear-yard setback (35 feet required; 31 feet proposed).
“The stairs and the deck don’t meet the setback requirements,” Salisbury Township Planning and Zoning Officer Kerry H. Rabold said.
“I’m not proposing anything out of the ordinary,” Cassella said.
“Every house has a deck,” Cassella said of the Trout Spring Gardens area where his house is located.
A previous deck had rotted and was removed, Cassella said.
“The whole plan is to rebuild the deck and add egress,” Cassella said.
“This would supply an exit from the second floor,” Cassela said of the bi-level house.
“The character of the neighborhood would not be changed by building the deck,” Salisbury Township Planning Commission Chairman Attorney Kent Herman said.
Zoners voted 5-0 at the July 13 hearing to grant the variance.
In the second zoning case at the July 13 hearing, the appeal of Saucon Construction LLC, 1766 Virginia Ave., was granted for a request for dimensional variance relief to construct a new, single-family, detached dwelling on a lot of 6,500 square feet (20,000 square feet required with on-site well) and only 50 feet wide at the building setback line (90 feet required).
A house on the lot was demolished.
“The house was dilapidated and was an uninhabitable place,” Rabold said.
“This lot was created before zoning. A lot created before zoning creates a hardship,” Salisbury Township Zoning Hearing Board Solicitor Attorney Victor F. Cavacini of Gross McGinley, LLP said.
The proposed three-bedroom bi-level would be 1,300 square feet.
“It fronts on Virginia Avenue and to the rear is an unoptioned street,” Bryan Ritter, president, Jena Engineering Corp., project engineer, said of the site for the new house.
Zoners voted 5-0 at the July 13 hearing to grant the variance.
The Salisbury Township Zoning Hearing Board Aug. 10 meeting is canceled.
The Salisbury Township Planning Commission July 27 meeting is canceled.
The Salisbury Township Board of Commissioners is to meet 7 p.m. July 28 in the township municipal building, 2900 S. Pike Ave.
