Lehigh County District Attorney announces charges in crash that killed couple
A delivery truck driver faces charges in a crash with a motorcycle in which a husband and wife were fatally injured in June, 2021.
In a media release dated Dec. 27, 2021, District Attorney Jim Martin and Pennsylvania State Police Capt. Derek A. Koch announced the filing of charges in a crash in which motorcyclist Robert O’Rourke, 55 and his wife, Mary O’Rourke, 54, his passenger on the motorcycle, died.
Mary O’Rourke was a registered nurse and worked for the Lehigh Valley Health Network, according to the obituary for the couple.
Robert O’Rourke was an arborist with The Davey Tree Company in New Jersey.
According to the media release, Devon Michael Lindeman, 23, of Allentown, is charged with alleged homicide by vehicle, a felony of the third degree; recklessly endangering another person, a misdemeanor of the second degree and summary charges of failing to use a safety belt – driver and front seat occupant, driving at safe speed and operating with unsafe equipment.
Lindeman was arraigned Dec. 27, 2021, according to authorities.
The media release details the accident as follows:
Pennsylvania State Police were called to a crash on Pennsylvania Route 145, North Whitehall Township, involving a FedEx delivery truck and a motorcycle June 21, 2021. The driver and the passenger on the motorcycle died at the crash scene.
Both died of multiple blunt force injuries and their deaths were ruled accidental by the Lehigh County Coroner’s office.
According to authorities, an investigation revealed a FedEx truck, driven by Lindeman, was traveling south on Route 145, north of Clearview Road, North Whitehall Township, at the time of the accident.
Lindeman was observed on a window-mounted camera to be allegedly driving the vehicle without a seatbelt, according to the media release.
After negotiating a left curve in the road, the right side tires of the truck exited the west side of the lane and entered the paved asphalt and gravel shoulder.
The delivery truck continued south, crossed the center double yellow line and entered the northbound lane nearly striking an off-duty police officer who was traveling north on Pennsylvania Route 145.
“As the truck returned to the southbound lane, it again returned to the northbound lane a second time where Lindeman fell out of his seat and onto the passenger-side floor area. While in the northbound lane, the truck struck the motorcycle,” according to the media release.
Bail for Lindeman was set at $50,000, according to authorities.
The O’Rourkes, both born in Allentown, participated in rides for many local charities, according to their joint obituary.
