Allentown pair charged with conspiracy, retail theft
A man and woman from Allentown were charged with criminal conspiracy - retail theft just before 3 p.m. Feb. 22 after they allegedly removed assorted clothing from Burlington, 7150 Hamilton Blvd., Trexlertown.
According to Upper Macungie Township police, Carlos Albert Gutierrez, 30 and Ana Iris Santos-Pacheco, 34, both of the 1400 block of Turner St., Allentown, were attempting to flee from the scene in a vehicle and police conducted a vehicle stop in the store’s parking lot.
Police allege while taking the couple into custody, Gutierrez actively resisted arrest and Santos-Pacheco interfered with his arrest.
Officers discharged several Tasers in an attempt to take Gutierrez into custody, however, he was able to flee on foot. He was allegedly seen climbing the perimeter fence at Air Products and continued fleeing on foot on the grounds in an effort to avoid apprehension.
Gutierrez, however, was ultimately apprehended on the grounds of Air Products.
Police say one responding officer sustained a fractured hand allegedly as a result of Gutierrez resisting arrest.
The clothing items allegedly stolen by the couple were recovered, police say.
In addition to the criminal conspiracy retail theft charge, Gutierrez and Santos-Pacheco were both charged with retail theft, a misdemeanor of the first degree and disorderly conduct, a misdemeanor in the three degree.
Gutierrez was also charged with resisting arrest and escape, each misdemeanors of the second degree.
Santos-Pacheco was also charged with driving while her operating privilege was suspended or revoked, a summary offense.
The two were transported to Lehigh County Central Booking Center for arraignment.
State police and South Whitehall, Alburtis, Macungie borough and Emmaus police and its K-9 unit and Cetronia Ambulance Corps assisted at the scene.
According to Lehigh County criminal court records, Gutierrez and Santos-Pacheco were arraigned Feb. 22 before District Judge Todd P. Heffelfinger, Whitehall.
Their bail was set at $50,000 each.
Neither was able to post bail and both were confined to Lehigh County Jail.
A preliminary hearing for Gutierrez and Santos-Pacheco is scheduled 11 a.m. March 2 before Judge Heffelfinger.
