Driver charged with homicide by vehicle for crash

Lehigh County District Attorney Jim Martin announced Tuesday a Slatington man has been charged with homicide by vehicle while driving under the influence and other offenses related to a February fatal crash in Washington Township.

Martin said Joshua Douglas Moser, 25, of 1513 Fernwood Road, Slatington, was charged with homicide by vehicle while driving under the influence, a felony of the first degree; homicide by vehicle, a felony of the third degree; two counts of driving under the influence of alcohol or controlled substance, ungraded misdemeanors; involuntary manslaughter, a misdemeanor of the first degree; two counts of recklessly endangering another person, misdemeanors of the second degree; and three summary offenses including driving at an unsafe speed; and reckless driving.

Moser was arraigned at Central Booking by Magisterial District Judge Rod Beck, Slatington.

His bail was set at $200,000, unsecured.

At approximately 11:55 p.m. on Feb. 19, Trooper Michael Hodgskin was dispatched to Rextown Road in Washington Township.

Upon arrival, he discovered a one-vehicle crash involving a 2000 BMW 323i.

The car was on its roof and had sustained heavy body and mechanical damage.

The front of the car was on the lawn of 8756 Rextown Road. The rear was in the southbound lane.

There was a trail of debris several hundred feet in length. Allegedly included in the wreckage was an empty bottle of vodka.

Evidence indicated the BMW had been traveling northbound when its driver attempted to negotiate a right curve and struck an embankment and tree stump.

The car overturned, rolling over as it re-entered the roadway, and continued traveling northbound where it came to a stop at the Rextown Road property.

Trooper Hodgskin saw two males receiving medical treatment by EMS and fire personnel already on the scene.

One of the males, Clark Knoblauch, 25, told the trooper he had been a passenger in the automobile, and the other male, later identified as Joshua Moser, was the driver. PennDOT checks confirmed the BMW was registered to Moser.

Knoblauch also stated there had been another passenger in the car.

Trooper Hodgskin learned the passenger, a female, was in the back of the ambulance receiving medical care. Medical personnel had found her a few feet off the roadway, lying face down on the grass and unresponsive.

She was airlifted to St. Luke’s Fountain Hill where she was pronounced dead at 1:28 a.m. The victim was identified as Nicole Marie Gruber, age 24, of Slatington.

Knoblauch told Trooper Hodgskin the three had been at the Shack, a Slatington bar, prior to the accident.

Trooper Hodgskin reported Moser allegedly had bloodshot, watery, glassy eyes at the scene of the collision.

Knoblauch and Moser were taken to Lehigh Valley Hospital, Salisbury Township, for further treatment of their injuries.

While in the emergency room, a blood sample was taken from Moser, revealing an alleged blood alcohol level of 0.15 percent.
