State Police Troop M Fogelsville say Ben Zaboy, 35, of Kempton, was driving a 2006 Volkswagen Jetta westbound in the 8900 block of Kings Highway, Lynn Township, around 3 a.m. Dec. 6, when he allegedly swerved to miss a deer.

Police say the Jetta, which struck a tree on the right side of the road causing significant damage to the right front bumper, was unable to be driven from the scene.

Police allege Zaboy exhibited signs of intoxication. He was arrested for suspicion of DUI.

Zaboy was processed and released. Police say charges are pending.

No injuries were reported, police say.
