Teen to remain in county prison, Judge Dantos says

Jamie Lynn Silvonek, 14, of Upper Macungie Township, charged with killing her mother, Cheryl, will remain in Lehigh County Prison.

According to information provided by Attorney Michael Stitt from the law office of Huber, Waldron and Williams, a motion was filed for Silvonek to be transferred back to the juvenile detention center but District Attorney Jim Martin opposed the transfer and Judge Maria Dantos of the Lehigh County Court of Common Pleas, denied the motion made by Silvonek's attorney, John Waldron.

"We believe our client should be in juvenile court and we will file a motion to transfer her to juvenile court after the preliminary hearing," Stitt stated in an email to The Press.

She has never been in trouble with the law before now, he said.

Silvonek's boyfriend, Caleb Gregory Barnes, U.S. Army Specialist 4 stationed at Fort Meade, Md., is accused of fatally stabbing Cheryl Silvonek in the early morning hours of March 15 as the three sat in the family's 2007 Ford Freestyle in the driveway at 1516 Randi Lane, Upper Macungie, then burying her body in the 5700 block of Haasadahl Road, South Whitehall Township.

According to the affidavit of probable cause, Silvonek originally met Barnes at a concert in Philadelphia in October 2014.

In addition, it states, on the evening of March 7, when Barnes returned to his Army base after visiting Jamie Lynn Silvonek, she and Barnes had a cell phone conversation in which Silvonek allegedly suggested a plan to kill her parents, according to another juvenile who was at the Silvonek home when the conversation between allegedly took place.

"We believe Barnes was the one who was the controlling party in the death of Cheryl Silvonek," Stitt said. "We also believe Barnes threaten our client prior to and after the death of her mother."

He said it is their understanding Jamie Lynn Silvonek was under some type of duress or coercion at the time of her mother's death and Barnes allegedly raped Jamie Lynn Silvonek after killing her mother.

Dr. Frank Dattilio, Ph.D., ABPP in clinical and forensic psychology, is conducting an evaluation of Jamie Lynn Silvonek, Stitt said.

Stitt said after Cheryl Silvonek's body was found buried in South Whitehall Township, Jamie Lynn Silvonek was questioned by South Whitehall police without a guardian present the entire time.

"Her grandmother was briefly there but left and her dad [David Silvonek] was a suspect at the time," Stitt stated.

Stitt said motions will probably be filed as to whether it was legal for Jamie Lynn Silvonek to be there by herself and the questioning by police to continue.

A preliminary hearing for Silvonek is scheduled for 9:30 a.m. May 14 in Lehigh County Central Court, Allentown.
