No charges will be filed in U. Mac Halloween fatality

Lehigh County District Attorney Jim Martin has announced no charges will be filed in connection with an Oct. 26, 2012 fatal accident in which Jordan Steinmetz, 14, was killed.

Steinmetz was walking west near 6429 Schantz Road, Upper Macungie, around 8:20 p.m. when he was struck by a vehicle driven west on Schantz Road by a 29-year-old Whitehall Township man.

According to Martin, there are no shoulders or curbs in the area of the crash and the posted speed limit is 35 mph.

Martin said it was a partly cloudy night, there are no streetlights in the area and Steinmetz was wearing dark, non-reflective street clothes.

The driver immediately stopped, called for help and checked on Steinmetz.

He stayed at the scene and cooperated fully with police, Martin said.

Steinmetz was taken to Lehigh Valley Hospital, Salisbury Township, where he later was pronounced dead.

Police analyzed evidence at the scene and made a diagram of the area, interviewed the driver and other motorists, and inspected the vehicle.

"I determined, based on all evidence collected during the investigation, the motorist did not engage in any criminal conduct that was a principal factor in causing the accident," Martin said.

Chief Deputy District Attorney V. Paul Bernardino III met with the Steinmetz's parents, the boy who was walking with Steinmetz and the boy's father on March 15 to explain the investigation and conclusion.
